Please read these terms carefully before using our service.

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AdvancedPayday ("Company," "we," "us," or "our"), governing your access to and use of the website located at myadvancedpayday.com (the "Site") and all related services.
By accessing or using this Site, you affirm that you are at least 18 years of age, a legal resident of the United States (excluding North Carolina), and have the legal capacity to enter into this agreement. If you do not agree to these Terms, do not use this Site.
2. Nature of Service — Lead Generation Only
AdvancedPayday is NOT a lender. We are a lead generation and marketing platform that connects consumers with a network of independent, licensed third-party lenders. We do not:
- Make credit decisions or approve or deny loan applications
- Issue, fund, or service loans
- Guarantee that you will be matched with a lender or approved for any loan
- Determine the interest rates, fees, or terms offered by any lender
- Act as an agent or representative of any lender
Any loan offer you receive is solely from a third-party lender. We receive compensation from lenders for connecting consumers with them. This compensation may influence which lenders we work with but does not affect the loan terms offered to you.
3. Eligibility Requirements
To use our service, you must meet all of the following requirements:
- Be at least 18 years of age (19 in Alabama and Nebraska)
- Be a legal resident of the United States
- NOT be a resident of North Carolina
- Have a valid Social Security Number
- Have an active checking or savings account at a U.S. financial institution
- Have a verifiable source of income
- Have a valid email address and phone number
- Not currently be in bankruptcy proceedings
4. Loan Terms and Cost of Credit
We do not control the rates or terms offered by lenders in our network. The following disclosures are provided for informational purposes only:
Annual Percentage Rate (APR) Disclosure
Payday and short-term installment loans typically carry high APRs. APRs in our lender network generally range from 200% to 750% or more, depending on loan amount, term, lender, and your state of residence. For example: a $300 loan for 14 days with a $45 fee has an APR of approximately 391%.
Total Cost of Credit Example
If you borrow $500 for 30 days at an APR of 400%, the finance charge would be approximately $164.38, making the total repayment approximately $664.38. Actual costs vary by lender.
Short-term loans should be used only for short-term financial needs and not as long-term financial solutions. Please borrow responsibly and only what you can afford to repay.
5. California Residents — Special Disclosures
Loans made or arranged by our lending partners to California residents are made pursuant to California Financing Law (Cal. Fin. Code § 22000 et seq.) licenses held by the respective lenders. License numbers are available upon request from each lender.
Under the California Consumer Financial Protection Law (CCFPL) and California Financing Law, California residents have the following additional rights:
- Right to Rescind: You may cancel a loan without penalty within one (1) business day of the loan date by returning the full principal amount to the lender.
- APR Cap: For loans under $2,500, California law limits the finance charge. Review your specific loan agreement for applicable rate information.
- Prepayment: You have the right to prepay your loan in full at any time without penalty.
- California Privacy Rights: California residents have additional privacy rights under the California Consumer Privacy Act (CCPA). See our Privacy Policy for details.
- DFPI Complaint: Complaints about lenders may be submitted to the California Department of Financial Protection and Innovation (DFPI) at dfpi.ca.gov or 1-866-275-2677.
6. Military Lending Act (MLA) Notice
Federal law provides important protections to members of the Armed Forces and their dependents. The Military Lending Act caps the APR for covered loans to active-duty service members and their dependents at 36% MAPR. If you are an active-duty service member or a covered dependent, you may be entitled to additional protections. Contact your lender for details or visit the Consumer Financial Protection Bureau (CFPB) at consumerfinance.gov.
7. Truth in Lending Act (TILA) Notice
Lenders in our network are required to provide you with written disclosures of the cost of credit before you sign any loan agreement, pursuant to the Truth in Lending Act (15 U.S.C. § 1601 et seq.). These disclosures include the APR, finance charge, total amount financed, and total of payments. Review all disclosures carefully before signing.
8. Equal Credit Opportunity Act (ECOA) Notice
The Federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), because all or part of the applicant's income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act.
If any lender takes adverse action on your application, you have the right to a written statement of specific reasons for the denial. Contact the lender within 60 days of receiving notice of their decision.
9. Electronic Signature and Communications Consent (ESIGN Act)
By submitting a loan request through our Site, you consent to conducting transactions electronically and agree that your electronic signature has the same legal effect, validity, and enforceability as a handwritten signature, pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.).
You also consent to receive all disclosures, notices, and communications from us and participating lenders electronically, including via email. You may withdraw this consent at any time by contacting us, but doing so may affect your ability to use our services.
10. Information Sharing and Privacy
By submitting a request through our Site, you authorize AdvancedPayday and its lending partners to:
- Share your personal and financial information with lenders in our network
- Verify your identity and employment information
- Pull credit reports (soft or hard inquiries, as disclosed by each lender)
- Contact you by phone, email, or text message regarding your application
We may also share your information with marketing partners. See our Privacy Policy for full details on how we collect, use, and share your information.
11. No Guarantee of Approval
Submitting a request through our Site does not guarantee that you will be connected with a lender, receive a loan offer, or be approved for a loan. Lender approval depends on the lender's own underwriting criteria, applicable state law, and your individual circumstances.
12. Arbitration Agreement and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of this Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to: AdvancedPayday, Attn: Legal, info@myadvancedpayday.com.
13. Disclaimer of Warranties
THIS SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVANCEDPAYDAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE OR ANY LOAN OBTAINED THROUGH OUR NETWORK, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions, except where otherwise required by applicable state law.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
17. State-Specific Information
Loan products, rates, and availability vary significantly by state. Some states may have rate caps, cooling-off periods, or other consumer protections that apply to your loan. Your lender is responsible for disclosing all applicable state-specific terms.
Loans are not available in: North Carolina. Availability in other states depends on lender network participation and applicable state licensing requirements.
